{"id":865,"date":"2021-01-15T23:55:00","date_gmt":"2021-01-15T23:55:00","guid":{"rendered":"http:\/\/bklaw.com.co\/?p=865"},"modified":"2021-11-05T05:56:13","modified_gmt":"2021-11-05T00:56:13","slug":"scope-of-the-legal-institution-of-enhanced-stability-is-extended","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/se-amplio-el-espectro-de-la-estabilidad-reforzada\/","title":{"rendered":"Se ampli\u00f3 el espectro de la estabilidad reforzada"},"content":{"rendered":"<p>La Corte Constitucional aclar\u00f3 que la protecci\u00f3n de estabilidad reforzada en materia laboral no se limita al empleado que por una condici\u00f3n de discapacidad deba ausentarse de su cargo, sino que, tambi\u00e9n ampara los derechos de qui\u00e9nes est\u00e1n dentro de un t\u00e9rmino de incapacidad otorgado por su m\u00e9dico tratante. Esto cobra especial relevancia en la evaluaci\u00f3n que debe adelantar el empleador para un despido.<\/p>\n\n\n\n<p>Para que exista la estabilidad reforzada debe acreditarse: (i) una condici\u00f3n de salud que impida o dificulte sustancialmente el desempe\u00f1o de labores en circunstancias regulares; (ii) el empleador debe conocer la condici\u00f3n de manera previa al despido y (iii) que no exista una justificaci\u00f3n suficiente para la desvinculaci\u00f3n; porque, de llevarse a cabo, constituir\u00eda discriminaci\u00f3n.<\/p>\n\n\n\n<p>De este modo, en caso de que el empleador tome la decisi\u00f3n de despedir a una persona que est\u00e1 en t\u00e9rmino de incapacidad, debe antes solicitar un permiso ante el Ministerio de Salud y Protecci\u00f3n Social.
