{"id":746,"date":"2021-08-23T21:32:00","date_gmt":"2021-08-23T21:32:00","guid":{"rendered":"http:\/\/bklaw.com.co\/?p=746"},"modified":"2021-11-05T04:00:24","modified_gmt":"2021-11-04T23:00:24","slug":"creation-of-the-new-paternity-privileges-in-colombia","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/creacion-del-nuevo-fuero-de-paternidad-en-colombia\/","title":{"rendered":"Creaci\u00f3n del Nuevo Fuero de Paternidad en Colombia"},"content":{"rendered":"<p>El Presidente de la Rep\u00fablica sancion\u00f3 la Ley 2141 de 2021 a trav\u00e9s de la cual se regulan aspectos claves del nuevo fuero de paternidad, modificando los Art\u00edculos 239 y 240 del C\u00f3digo Sustantivo del Trabajo. La novedad de esta ley consiste en la creaci\u00f3n del fuero de paternidad que proh\u00edbe a los empleadores despedir a un trabajador cuyo c\u00f3nyuge, pareja, o compa\u00f1era permanente: (i) se encuentre en estado de embarazo o dentro de las dieciocho (18) semanas posteriores al parto y (ii) no posea un empleo formal.<\/p>\n\n\n\n<p>El trabajador que est\u00e1 protegido por el fuero de paternidad solo podr\u00e1 ser despedido cuando exista una justa causa y la decisi\u00f3n sea avalada por el Inspector del Trabajo o el Alcalde Municipal, en los lugares donde no haya un Inspector de Trabajo. Si el despido se lleva a cabo sin la autorizaci\u00f3n requerida, el empleador se expone al posible reintegro del trabajador por orden judicial y tambi\u00e9n a sanciones monetarias, entre ellas una indemnizaci\u00f3n al trabajador equivalente al salario de sesenta (60) d\u00edas de trabajo.<\/p>\n\n\n\n<p>Sin embargo, el fuero de paternidad no surge autom\u00e1ticamente. Para que se genere esta protecci\u00f3n es necesario que el trabajador notifique al empleador que su c\u00f3nyuge, pareja o compa\u00f1era permanente se encuentra en estado de embarazo y que declare bajo la gravedad de juramento que esta no posee un empleo formal. Esta notificaci\u00f3n podr\u00e1 hacerse verbalmente o por escrito y deber\u00e1 acompa\u00f1arse de una prueba que acredite el estado de embarazo.<\/p>\n\n\n\n<p>En B\u00e9ndiksenLaw estamos al tanto de los cambios legislativos relevantes para su compa\u00f1\u00eda.
