{"id":317,"date":"2021-06-23T10:59:00","date_gmt":"2021-06-23T05:59:00","guid":{"rendered":"http:\/\/bklaw.com.co\/?p=317"},"modified":"2021-11-05T04:11:32","modified_gmt":"2021-11-04T23:11:32","slug":"the-colombian-congress-approved-reduction-of-the-work-week","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/el-congreso-aprueba-jornada-laboral-reducida\/","title":{"rendered":"El Congreso aprueba jornada laboral reducida"},"content":{"rendered":"<p>El Congreso de la Rep\u00fablica aprob\u00f3 un proyecto de ley en el cual se busca la reducci\u00f3n de la jornada laboral de cuarenta y ocho (48) horas semanales a cuarenta y dos (42), por lo que ahora este proyecto se encuentra a la espera de sanci\u00f3n presidencial. La disminuci\u00f3n horaria aprobada se har\u00eda de forma paulatina. Durante los dos primeros a\u00f1os de vigencia de la ley no se plantea disminuci\u00f3n alguna. Se comenzar\u00eda esta reducci\u00f3n durante el 2023 y el 2024 en una (1) hora por a\u00f1o.  Para el 2025 y el 2026 se pretende la reducci\u00f3n de dos (2) horas de la jornada laboral por a\u00f1o, para as\u00ed llegar a la meta de una jornada de cuarenta y dos (42) horas semanales en el a\u00f1o 2027.<\/p>\n\n\n\n<p>Esta reducci\u00f3n horaria no implicar\u00eda una reducci\u00f3n salarial para los trabajadores. Tampoco afectar\u00eda los derechos adquiridos y\/o garant\u00edas de los trabajadores con sus empleadores. Sin embargo, este proyecto de ley tambi\u00e9n pretende exonerar a los empleadores de la aplicaci\u00f3n de dos disposiciones normativa concretas, las cuales son:<\/p>\n\n\n\n<p>(i) Art\u00edculo 3\u00ba de la Ley 1857 de 2017, este art\u00edculo se refiere a la posibilidad de que el empleador y el trabajador acuerden un horario y\/o condiciones de trabajo flexibles para que el trabajador pueda atender los deberes de acompa\u00f1amiento y protecci\u00f3n a su familia.<\/p>\n\n\n\n<p>(ii) Art\u00edculo 21 de la Ley 50 de 1990, el cual se refiere a la obligaci\u00f3n del empleador que cuente con cincuenta (50) trabajadores o m\u00e1s, de dedicar dos (2) horas de la jornada laboral semanal a actividades deportivas, culturales o de capacitaci\u00f3n.<\/p>\n\n\n\n<p>Si bien iniciativas similares han sido aplicadas en otros pa\u00edses del mundo con buenos resultados, demostrando que puede mantenerse o aumentarse la productividad, diferentes gremios del pa\u00eds se han opuesto a esta iniciativa puesto que para ellos la sola reducci\u00f3n no es sin\u00f3nimo de mejor\u00eda. Los opositores de la iniciativa legislativa han propuesto que para alcanzar una mejor\u00eda se requiere:  planes reducci\u00f3n de tiempo en procesos al interior de las empresas, automatizaci\u00f3n de procesos y una mayor capacitaci\u00f3n de los trabajadores, estrategias que no han sido planteadas en este proyecto.<\/p>\n\n\n\n<p>La falta de dichas estrategias, sumado a la reducci\u00f3n de la jornada, ha generado la cr\u00edtica de que habr\u00e1 una sobrecarga laboral para algunos trabajadores pues muchas labores no ser\u00e1n terminadas a cabalidad durante una jornada de cuarenta y dos (42) horas y deber\u00e1n ser asumidas por los trabajadores m\u00e1s comprometidos al interior de cada compa\u00f1\u00eda.<\/p>\n\n\n\n<p>\u00bfQu\u00e9 opina usted de este proyecto de ley?
