{"id":1885,"date":"2023-01-13T09:20:00","date_gmt":"2023-01-13T04:20:00","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1885"},"modified":"2023-01-13T20:18:05","modified_gmt":"2023-01-13T15:18:05","slug":"reduction-of-weekly-working-hours-in-colombia","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/reduccion-de-jornada-laboral-semanal\/","title":{"rendered":"Reducci\u00f3n de Jornada Laboral Semanal"},"content":{"rendered":"<p>A trav\u00e9s de la Ley 2101 de 2021 se orden\u00f3 la reducci\u00f3n de la jornada laboral semanal en Colombia de manera gradual, sin que esta reducci\u00f3n implique una disminuci\u00f3n o afectaci\u00f3n en el salario y\/o derechos adquiridos de los trabajadores. As\u00ed, la duraci\u00f3n m\u00e1xima de la jornada ordinaria de trabajo semanal se disminuy\u00f3 en seis (6) horas, pasando de cuarenta y ocho (48) horas semanales a cuarenta y dos (42). Esta ley permite que el empleador implemente la reducci\u00f3n en la jornada laboral semanal de manera autom\u00e1tica, es decir, que disminuya la totalidad de las seis (6) horas de manera inmediata. Sin embargo, la ley tambi\u00e9n faculta a los empleadores para que implementen esta reducci\u00f3n de manera gradual, de la siguiente forma:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Fecha<\/td><td>N\u00famero de Horas a Reducir<\/td><td>Jornada M\u00e1xima Legal<\/td><\/tr><tr><td>A partir del 16 de julio de 2023<\/td><td>Una (1) hora<\/td><td>47 horas semanales<\/td><\/tr><tr><td>A partir del 16 de julio de 2024<\/td><td>Una (1) hora<\/td><td>46 horas semanales<\/td><\/tr><tr><td>A partir del 16 de julio de 2025<\/td><td>Dos (2) horas<\/td><td>44 horas semanales<\/td><\/tr><tr><td>A partir del 16 de julio de 2026<\/td><td>Dos (2) horas<\/td><td>42 horas semanales<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>De acuerdo a lo anterior, a partir del 16 de julio del a\u00f1o en curso, ser\u00e1 obligatorio que los empleadores modifiquen la duraci\u00f3n de la jornada laboral semanal de sus trabajadores para que no supere un total de cuarenta y siete (47) horas a la semana. Dichas horas podr\u00e1n distribuirse en cinco (5) o seis (6) d\u00edas a la semana, de acuerdo a lo que acuerden mutuamente el empleador y el trabajador, debiendo garantizarse en todo caso un (1) d\u00eda de descanso a la semana. Sin embargo, la Ley 2101 establece las siguientes excepciones:<\/p>\n\n\n\n<p>1. Aquellas labores que impliquen un alto riesgo para la salud de los trabajadores de acuerdo a lo establecido en el Decreto 2090 de 2003, podr\u00e1n estar sujetas a una jornada de trabajo m\u00e1xima diferente en caso de que el gobierno as\u00ed lo decida. Sin embargo, a la fecha no hay ninguna regulaci\u00f3n especial al respecto por lo que por ahora deber\u00e1n sujetarse a la jornada ordinaria m\u00e1xima de cuarenta y dos (42) horas;<\/p>\n\n\n\n<p>2. Los adolescentes mayores de quince (15) y menores de diecisiete (17) a\u00f1os que cuenten con autorizaci\u00f3n para trabajar, solo podr\u00e1n desempe\u00f1ar sus labores en jornada diurna m\u00e1xima de seis (6) horas diarias y treinta horas (30) a la semana y hasta las 6:00 de la tarde;<\/p>\n\n\n\n<p>3. Los adolescentes de diecisiete (17) a\u00f1os, solo podr\u00e1n trabajar en una jornada m\u00e1xima de ocho horas (8) diarias y cuarenta (40) horas a Ia semana y hasta las 8:00 de la noche;<\/p>\n\n\n\n<p>4. En el caso de los turnos de trabajo sucesivo que permiten que la empresa funcione sin soluci\u00f3n de continuidad durante todos los d\u00edas de la semana, los turnos no podr\u00e1n exceder de seis (6) horas al d\u00eda y treinta y seis (36) a la semana;<\/p>\n\n\n\n<p>5. Para el caso de las jornadas diarias flexibles, se podr\u00e1n distribuir las cuarenta y dos (42) horas de la jornada laboral en m\u00e1ximo seis (6) d\u00edas a la semana, teniendo como m\u00ednimo cuatro (4) horas continuas y m\u00e1ximo hasta nueve (9) horas diarias sin lugar a ning\u00fan recargo por trabajo suplementario.<\/p>\n\n\n\n<p>En caso de que tenga dudas al respecto, no dude en <a href=\"https:\/\/www.bendiksenlaw.co\/es\/contacto\/\">contactarnos<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Through Law 2101 of 2021, the gradual reduction of the weekly working day in Colombia was ordered.
