{"id":1762,"date":"2022-06-29T11:19:00","date_gmt":"2022-06-29T06:19:00","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1762"},"modified":"2022-06-29T21:55:21","modified_gmt":"2022-06-29T16:55:21","slug":"the-deadline-to-pay-the-legal-bonus-is-approaching","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/se-acerca-el-vencimiento-del-plazo-maximo-para-pagar-la-prima-de-servicios\/","title":{"rendered":"Se Acerca el Vencimiento del Plazo M\u00e1ximo para Pagar la Prima de Servicios"},"content":{"rendered":"<p class=\" translation-block\">De acuerdo al art\u00edculo 306 del C\u00f3digo Sustantivo de Trabajo, los empleadores tienen la obligaci\u00f3n de pagar a sus empleados una prestaci\u00f3n social denominada \u201cprima de servicios\u201d correspondiente a 30 d\u00edas de salario por a\u00f1o, es decir, por cada a\u00f1o laborado se deber\u00e1 reconocer 30 d\u00edas de salario. Esta prima deber\u00e1 reconocerse en dos pagos: la mitad a m\u00e1s tardar el 30 de junio y la otra mitad a m\u00e1s tardar los primeros veinte d\u00edas de diciembre. El reconocimiento de este pago debe hacerse por todo el semestre trabajado o proporcionalmente al tiempo trabajado.<\/p>\n\n\n\n<p>Adicionalmente, debe tenerse en cuenta que todos los trabajadores que est\u00e9n vinculados mediante un contrato de trabajo tienen derecho a la prima de servicios, incluyendo trabajadores del servicio dom\u00e9stico, choferes de servicio familiar, trabajadores por d\u00edas o trabajadores de fincas y, en general, quienes sean considerados como trabajadores dependientes.<\/p>\n\n\n\n<p>De acuerdo a lo anterior, a m\u00e1s tardar el 30 de junio del a\u00f1o en curso usted tendr\u00e1 la obligaci\u00f3n de realizar un pago equivalente a la mitad del salario mensual que perciban sus trabajadores, para aquellos que han laborado desde el 1 de enero o antes. Para aquellos trabajadores que iniciaron labores despu\u00e9s del 1 de enero, se deber\u00e1 pagar el valor proporcional que corresponda de acuerdo al tiempo laborado. En caso de que no efect\u00fae el pago correspondiente antes de esta fecha, deber\u00e1 pagar, como indemnizaci\u00f3n, una suma igual al \u00faltimo salario diario por cada d\u00eda de retardo, hasta por 24 meses.
