{"id":1757,"date":"2022-06-21T20:37:15","date_gmt":"2022-06-21T15:37:15","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1757"},"modified":"2022-06-21T21:35:18","modified_gmt":"2022-06-21T16:35:18","slug":"time-frame-for-responding-to-requests-for-information-are-back-to-normal","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/normalizan-terminos-para-responder-derechos-de-peticion\/","title":{"rendered":"Normalizan T\u00e9rminos para Responder Derechos de Petici\u00f3n"},"content":{"rendered":"<p>El art\u00edculo 23 de la Constituci\u00f3n Pol\u00edtica de Colombia reconoce el derecho que tienen los ciudadanos de presentar solicitudes y hacer peticiones a las autoridades, con el fin de obtener informaci\u00f3n sobre situaciones de inter\u00e9s general y\/o particular. Adicionalmente, el C\u00f3digo de Procedimiento Administrativo y de lo Contencioso Administrativo establece que existe la posibilidad de que los ciudadanos presenten peticiones tambi\u00e9n ante organizaciones privadas cuando sea necesario para garantizar sus derechos fundamentales. Estas peticiones deber\u00e1n ser respondidas dentro del t\u00e9rmino que la ley se\u00f1ala.&nbsp;<\/p>\n\n\n\n<p>Al respecto, debe recordarse que en el marco de la emergencia sanitaria ocasionada por el COVID-19, se expidi\u00f3 el Decreto legislativo 491 de 2020, que estableci\u00f3 una ampliaci\u00f3n de dichos t\u00e9rminos para dar respuesta a las peticiones. As\u00ed, las entidades p\u00fablicas y privadas que recibieran derechos de petici\u00f3n ten\u00edan un plazo mayor para dar respuesta de fondo a las solicitudes que les fueran planteadas. Sin embargo, el pasado 17 de mayo, a trav\u00e9s de la Ley 2207 de 2022, se derog\u00f3 esta medida, por lo que los t\u00e9rminos para dar respuesta a las diferentes peticiones vuelven a ser los se\u00f1alados en el art\u00edculo 14 del C\u00f3digo de Procedimiento Administrativo y de lo Contencioso Administrativo, a saber:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Para peticiones de documentos y de informaci\u00f3n, las entidades tendr\u00e1n diez (10) d\u00edas h\u00e1biles para dar respuesta contados desde la recepci\u00f3n de la petici\u00f3n.&nbsp;<\/li><li>Para las peticiones dirigidas a las autoridades sobre consultas frente a temas que est\u00e1n a su cargo, se tendr\u00e1n treinta (30) d\u00edas h\u00e1biles contados desde la recepci\u00f3n de la petici\u00f3n.<\/li><li>Las dem\u00e1s peticiones que no se encuentren dentro de alguno de los supuestos anteriormente mencionados deber\u00e1n resolverse dentro de los quince (15) d\u00edas h\u00e1biles siguientes a su recepci\u00f3n.<\/li><\/ol>\n\n\n\n<p>Para m\u00e1s informaci\u00f3n, no dude en <a href=\"https:\/\/www.bendiksenlaw.co\/es\/contacto\/\">contactarnos<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Article 23 of the Colombian Constitution recognizes citizens\u2019 right to submit requests and petitions before the authorities, in order to obtain information on situations of general and\/or particular interest.
