{"id":1387,"date":"2022-01-18T16:41:00","date_gmt":"2022-01-18T11:41:00","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1387"},"modified":"2022-01-19T04:11:57","modified_gmt":"2022-01-18T23:11:57","slug":"new-recommendations-for-workers-protection-during-he-fourth-peak-of-the-covid-19-pandemic","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/nuevas-recomendaciones-para-la-proteccion-de-trabajadores-durante-el-cuarto-pico-de-la-pandemia-por-covid-19\/","title":{"rendered":"Nuevas Recomendaciones para la Protecci\u00f3n de Trabajadores Durante el Cuarto Pico de la Pandemia por COVID \u2013 19"},"content":{"rendered":"<p>El 13 de enero del a\u00f1o en curso, los Ministerios del Trabajo y de Salud y Protecci\u00f3n Social expidieron la Circular Conjunta No. 004 de 2022 mediante la cual se promueven nuevas medidas preventivas frente al aumento de contagios por COVID-19 que se viene presentando en el pa\u00eds debido la propagaci\u00f3n de la variante \u00d3micron, con la finalidad de garantizar la salud y bioseguridad de los trabajadores y disminuir la demanda de los servicios en salud. As\u00ed, se dictaron nuevas directrices con respecto al aislamiento obligatorio que deber\u00e1n cumplir de forma inmediata tanto aquellas personas que cuenten con s\u00edntomas como quienes sean asintom\u00e1ticos pero hayan estado en contacto estrecho con un caso confirmado de COVID-19.<\/p>\n\n\n\n<p>De esta forma, para las personas sintom\u00e1ticas, sin importar su estado de vacunaci\u00f3n, si cuentan o no con factores de riesgo e independientemente de su edad, deber\u00e1n aislarse por siete (7) d\u00edas contados a partir del inicio de los s\u00edntomas, sin que se requiera la realizaci\u00f3n de una prueba diagn\u00f3stica pues, de conformidad con los lineamientos para el uso de pruebas diagn\u00f3sticas para COVID-19 en Colombia, estas se reservan para personas mayores de 60 a\u00f1os, menores de tres (3) a\u00f1os y quienes cuenten con factores de riego. As\u00ed, bastar\u00e1 con el inicio de los s\u00edntomas para que se adquiera la obligaci\u00f3n de aislamiento, sin que esto obste para que acudan a un profesional de la salud para recibir la atenci\u00f3n correspondiente.<\/p>\n\n\n\n<p>De igual forma, las personas que son asintom\u00e1ticas pero que han tenido contacto estrecho con un caso confirmado de COVID-19 y que no cuenten con el esquema completo de vacunaci\u00f3n, tambi\u00e9n deber\u00e1n aislarse por un per\u00edodo de siete (7) d\u00edas contados desde el primer d\u00eda de exposici\u00f3n. En caso de que la persona no pueda realizar teletrabajo o trabajo remoto, podr\u00e1 acudir a un profesional de la salud con la finalidad de que este ordene la toma de la prueba diagn\u00f3stica y se esclarezca su situaci\u00f3n y as\u00ed evitar la propagaci\u00f3n del virus entre sus compa\u00f1eros de trabajo. Sin embargo, en caso de que se cuente con el esquema completo de vacunaci\u00f3n, no deber\u00e1n cumplir con este aislamiento ni deber\u00e1n tomarse la prueba diagn\u00f3stica, solo debiendo abstenerse de participar en eventos que impliquen aglomeraci\u00f3n y evitando el contacto estrecho con personas mayores de 60 a\u00f1os, ni\u00f1os menores de tres (3) a\u00f1os o con personas que cuenten con alg\u00fan factor de riesgo durante un per\u00edodo de siete (7) d\u00edas contados desde el d\u00eda de exposici\u00f3n.<\/p>\n\n\n\n<p>En resumen, as\u00ed proceder\u00e1 el aislamiento obligatorio y la toma de pruebas:<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"647\" height=\"236\" src=\"https:\/\/www.bendiksenlaw.co\/wp-content\/uploads\/2022\/01\/tabla-1.png\" alt=\"\" class=\"wp-image-1397\" srcset=\"https:\/\/www.bendiksenlaw.co\/wp-content\/uploads\/2022\/01\/tabla-1.png 618w, https:\/\/www.bendiksenlaw.co\/wp-content\/uploads\/2022\/01\/tabla-1-300x117.png 300w, https:\/\/www.bendiksenlaw.co\/wp-content\/uploads\/2022\/01\/tabla-1-18x7.png 18w\" sizes=\"(max-width: 647px) 100vw, 647px\" \/><\/figure>\n\n\n\n<div class=\"wp-block-columns are-vertically-aligned-center is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\"><\/div>\n<\/div>\n\n\n\n<p>Es importante que los empleadores tengan en cuenta que una vez el trabajador cumpla con este aislamiento obligatorio, podr\u00e1 retornar al desarrollo de sus actividades laborales sin que sea necesario que presente una prueba diagn\u00f3stica de COVID-19. Por \u00faltimo, estas nuevas medidas no autorizan el incumplimiento de las medidas de protecci\u00f3n laboral que ya han sido previamente adoptadas por el Ministerio del Trabajo en materia de protecci\u00f3n del empleo en el marco de la emergencia sanitaria.<\/p>\n\n\n\n<p>En B\u00e9ndiksenLaw estamos al tanto de los cambios normativos relevantes para su compa\u00f1\u00eda.
