{"id":1376,"date":"2021-11-30T18:00:00","date_gmt":"2021-11-30T13:00:00","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1376"},"modified":"2021-12-01T03:53:18","modified_gmt":"2021-11-30T22:53:18","slug":"colombian-senate-approves-bill-that-seeks-to-recognize-the-right-to-disconnect","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/el-senado-aprueba-proyecto-de-ley-que-busca-reconocer-el-derecho-a-la-desconexion-laboral\/","title":{"rendered":"El Senado aprueba Proyecto de Ley que Busca Reconocer el Derecho a la Desconexi\u00f3n Laboral"},"content":{"rendered":"<p>El 17 de noviembre el Senado de la Rep\u00fablica aprob\u00f3 en \u00faltimo debate el proyecto de ley de Desconexi\u00f3n Laboral que busca garantizar el respeto a los tiempos libres y descansos de los trabajadores para que puedan gozar plenamente de estos espacios y concilien la vida personal y familiar con la laboral. Este proyecto de ley entrar\u00e1 en vigencia una vez sea sancionado por el Presidente y se publique.<\/p>\n\n\n\n<p>Esta iniciativa establece que los empleadores no podr\u00e1n contactar por ning\u00fan medio a sus trabajadores para cuestiones laborales en horarios que no hagan parte de la jornada laboral, ni en sus vacaciones, licencias, permisos o descansos. En caso de que se desconozca lo anterior, los trabajadores podr\u00e1n hacer uso de los medios dispuestos por el empleador para presentar la queja correspondiente. Sin embargo, esto no obsta para que los trabajadores acudan tambi\u00e9n al Inspector de Trabajo, o ante la Procuradur\u00eda General de la Naci\u00f3n en caso de que se trate de un servidor p\u00fablico, teniendo en cuenta que el desconocimiento de este derecho podr\u00e1 entenderse como acoso laboral cuando ocurra de forma persistente y recurrente. As\u00ed mismo, los empleadores deber\u00e1n tener en cuenta que no podr\u00e1n exigir el cumplimiento de cualquier tipo de acuerdo o pacto que desconozca este derecho por lo que su inobservancia por parte del trabajador no podr\u00e1 tenerse como un incumplimiento de sus obligaciones laborales, raz\u00f3n por la cual no se podr\u00e1n imponer sanciones de ning\u00fan tipo ni terminar el contrato de quien haga uso de su derecho a la desconexi\u00f3n.<\/p>\n\n\n\n<p>Adicionalmente, con la finalidad de garantizar que efectivamente se cumplan estas disposiciones, todo \nempleador deber\u00e1 implementar una pol\u00edtica de desconexi\u00f3n laboral. Esta pol\u00edtica deber\u00e1 referirse a la forma en \nla cual se garantiza y ejerce este derecho a la desconexi\u00f3n y los lineamientos en cuanto a la utilizaci\u00f3n de las \nTecnolog\u00edas de la Informaci\u00f3n y las Comunicaciones. As\u00ed mismo, deber\u00e1 establecer los medios con los que \ncuentan los trabajadores para presentar quejas a nombre propio o an\u00f3nimamente, en caso de que consideren \nque su derecho a la desconexi\u00f3n laboral se est\u00e1 desconociendo o afectando. Estas quejas deber\u00e1n tramitarse de \ntal manera que se garantice el debido proceso, la soluci\u00f3n del conflicto y la cesaci\u00f3n de la conducta infractora.<\/p>\n\n\n\n<p>Sin embargo, los trabajadores y servidores p\u00fablicos que desempe\u00f1en cargos de direcci\u00f3n, confianza y manejo y aquellos que desempe\u00f1en labores que requieran de su disponibilidad permanente, no podr\u00e1n verse beneficiados por lo dispuesto en este proyecto de ley. As\u00ed mismo, los empleadores podr\u00e1n contactar a sus trabajadores despu\u00e9s del horario laboral o durante sus tiempos de descanso cuando as\u00ed se requiera por situaciones de fuerza mayor o caso fortuito en los que la continuidad del negocio y su correcta operaci\u00f3n se vean amenazadas.
