{"id":1233,"date":"2021-10-21T08:55:00","date_gmt":"2021-10-21T03:55:00","guid":{"rendered":"https:\/\/www.bendiksenlaw.co\/?p=1233"},"modified":"2021-11-05T03:56:24","modified_gmt":"2021-11-04T22:56:24","slug":"know-the-timeframe-to-protect-your-trademark-from-infringement-in-colombia","status":"publish","type":"post","link":"https:\/\/www.bendiksenlaw.co\/es\/conozca-los-plazos-que-tiene-para-proteger-su-marca-de-infracciones\/","title":{"rendered":"Conozca los Plazos que Tiene para Proteger su Marca de Infracciones"},"content":{"rendered":"<p>El pasado 25 de agosto el Tribunal de Justicia de la Comunidad Andina emiti\u00f3 una interpretaci\u00f3n prejudicial con respecto a la Acci\u00f3n por Infracci\u00f3n de los Derechos de Propiedad Industrial y a los plazos que tienen los titulares de la marca para hacer uso de esta protecci\u00f3n. En dicha interpretaci\u00f3n el Tribunal record\u00f3 que el titular de un registro de marca tiene, entre otros, el derecho a impedir que terceros hagan uso comercial de un signo id\u00e9ntico o similar, sin su autorizaci\u00f3n, en relaci\u00f3n con cualquier producto o servicio cuando represente alg\u00fan riesgo de confusi\u00f3n o asociaci\u00f3n en los consumidores con respecto al titular de la marca. En caso de que esto ocurra, el titular podr\u00e1 ejercer la acci\u00f3n por infracci\u00f3n de derechos de propiedad industrial. Sin embargo, es importante hacer uso de esta protecci\u00f3n tan pronto se tiene conocimiento de la infracci\u00f3n, pues con la finalidad de proteger la seguridad jur\u00eddica en el mercado, esta acci\u00f3n prescribe y no es posible su ejercicio indefinido en el tiempo.<\/p>\n\n\n\n<p>As\u00ed, la Decisi\u00f3n 486 de la Comisi\u00f3n de la Comunidad Andina en su art\u00edculo 244 establece que esta acci\u00f3n tiene un t\u00e9rmino de prescripci\u00f3n de dos a\u00f1os contados a partir del momento en el que el titular tuvo conocimiento de la infracci\u00f3n o a los cinco a\u00f1os contados desde que se cometi\u00f3 la infracci\u00f3n por \u00faltima vez. Despu\u00e9s del vencimiento de estos plazos, la acci\u00f3n se torna improcedente. Al respecto, el Tribunal de Justicia de la Comunidad Andina precis\u00f3 que el plazo de dos a\u00f1os se calcula desde que el titular del derecho tuvo conocimiento del acto infractor, sin importar el tipo de infracci\u00f3n de la que se trate. Por el contrario, para el plazo de cinco a\u00f1os se debe tener en cuenta el tipo de infracci\u00f3n y el desconocimiento de la infracci\u00f3n cometida de parte del titular. De esta forma, dependiendo de si se trata de una infracci\u00f3n instant\u00e1nea, continuada, permanente o compleja, la fecha desde la cual se computar\u00e1n los cinco a\u00f1os var\u00eda as\u00ed:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Ya que para las infracciones instant\u00e1neas basta con la realizaci\u00f3n de un \u00fanico acto que configura la infracci\u00f3n, el plazo se computa desde el mismo momento en el que se consuma el acto.<\/li><li>Con respecto a las infracciones continuadas, entendidas como actos id\u00e9nticos que se repiten en el tiempo de manera continuada y que hacen parte de un \u00fanico proceso, el plazo de prescripci\u00f3n se calcula desde la fecha de realizaci\u00f3n del \u00faltimo acto id\u00e9ntico.<\/li><li>Frente a las infracciones permanentes, o actos \u00fanicos que tienen una duraci\u00f3n prolongada en el tiempo, el plazo de cinco a\u00f1os se calcula desde el momento en el que cesa la conducta.<\/li><li>Por \u00faltimo, las infracciones complejas, que se tratan de series de m\u00faltiples actos cuya finalidad es alcanzar un \u00fanico fin, el plazo se computa desde la fecha de realizaci\u00f3n del \u00faltimo acto que consuma la infracci\u00f3n.<\/li><\/ul>\n\n\n\n<p>Por \u00faltimo, es importante tener en cuenta que en caso de que el titular del derecho sobre la marca deje pasar el plazo de dos a\u00f1os desde que tuvo conocimiento de la infracci\u00f3n, no podr\u00e1 acudir al plazo de cinco a\u00f1os, pues los supuestos que permiten su ejercicio son diferentes.
